Kevin Costner tried to get a lawsuit against him over an alleged unscripted rape scene tossed out of court … it wasn’t thrown out completely, but about a chunk is now gone.
According to new legal docs, obtained by TMZ, the judge in the case denied his motion to throw out all 10 of Devyn LaBella‘s claims … and instead tossed two.
One of those involved sexual harassment and the other involved an alleged violation of the Bane Act, which is intended to combat hate crimes.
Costner’s attorney, Marty Singer, tells TMZ … “We were pleased to learn that the Court granted our anti-SLAPP motion in part, dismissing two of the plaintiff’s claims (including one of her claims for sexual harassment).”
He continues … “While we were disappointed with the Court’s decision to allow her remaining causes of action to proceed, the evidence is clear that they have no legal or factual merit, and we plan to appeal the Court’s decision promptly. In spite of the plaintiff’s outlandish allegations, there was never any ‘simulated rape,’ ‘simulated sex’ or sexual harassment – and absolutely no retaliation. Rather, she is seeking millions of dollars for agreeing to participate in the rehearsal of a single, benign shot that even she admits was explained to her in advance. We will continue to fight for the truth and we are extremely confident we will prevail.”
As we’ve told you … LaBella sued back in May, claiming she was forced to participate in an unscripted and unscheduled rape scene on the set of the Western film series, “Horizon.”
Kevin’s insisted there was NO violent rape scene on his set … and he’s called the lawsuit a shake down.
TMZ broke the story … Kevin filed a motion to dismiss the lawsuit back in August … but the judge’s ruling didn’t come down until today.

As you know, the U.S. Dept. of Justice began releasing the long-awaited Epstein Files on Friday, the final day of a 30-day period the agency was compelled by Congress to produce all materials related to the investigation of Epstein — with victims’ identities and details redacted.
Jeffrey Epstein was convicted in 2008 on state charges in Florida of soliciting the prostitution of a minor in a plea deal and served a year in prison. In 2019, he was arrested on federal charges of sex trafficking of minors and conspiracy to commit sex trafficking of minors. While awaiting trial in New York City, he killed himself in his cell.
Donald Trump, Clinton and Bill Gates are among many high-profile politicians, entertainers, business titans, academics and other powerful international figures known to have been close associates of Epstein. Trump downplayed the importance of releasing the files this year — despite making campaign promises to open up the investigation — even saying he didn’t want support from anyone who was demanding more about the case.

The images are from the Epstein Files being released by the U.S. Department of Justice … and there are several photos showing Epstein cozying up to an unidentified female on a couch … it’s unclear if she’s underage.
Epstein has his arms around her, and they are horizontal, side by side on a couch … wearing clothes. Her face has been redacted to protect her identity, indicating the government considers her a victim.
There are 10 photos of the convicted pedo and this young female … and Epstein looks like he’s enjoying himself.

We’ve seen lots of other creepy Epstein photos leading up to Friday’s document dump, but this may be the creepiest yet.
